1. Acceptance

These Terms govern your use of the Herculane mobile application and its supporting API ("Service"). By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use account-based or community features.

2. The Service

Herculane provides information and discovery features relating to Băile Herculane and its surroundings, including places, local attractions, accommodations, restaurants, events, weather, maps, and community stories. Features may change, be unavailable, or depend on internet access and third-party services.

Information about places, routes, weather, opening hours, and local services is provided for general information. It may be incomplete, outdated, or inaccurate. Herculane is not an emergency service, a substitute for official travel or safety advice, or a guarantee that a route or facility is open or safe. Check current local conditions and official guidance before relying on information, especially when hiking or visiting natural areas.

3. Eligibility and Accounts

Some features require an account through the identity provider at id.aham.ro. Account features are intended for people aged 16 or older. You must provide accurate information where requested, protect your sign-in credentials, and promptly tell us if you believe your account has been accessed without authorization.

You may edit available profile information in the app. The currently reviewed API does not provide an account-deletion control. To request account deletion, contact admin@aham.ro. Deleting the app from your device does not delete your account or server-side content.

4. Your Content

You retain any rights you hold in the stories, text, photos, and other content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate Herculane, make it available according to your settings, and moderate or secure the Service. This license ends when the content is deleted, except for copies that must be retained by law or may remain temporarily in backups.

Drafts are associated with your account and are not published as stories until you choose to publish them. Published stories can be seen by other users. When you enable the option to allow pictures to be shared in galleries, you authorize the selected pictures to be made available for that gallery use. Do not submit images or information that you do not have the right to share.

You are responsible for your content and must ensure that you have the necessary rights and permissions. Do not submit unlawful, deceptive, threatening, harassing, discriminatory, or harmful content, infringe another person's rights, disclose someone else's sensitive information without permission, or use the Service to spam or mislead others.

We may remove or restrict content or access when reasonably necessary to enforce these Terms, comply with law, address safety concerns, or protect the Service and its users. You can delete available stories using the app controls or contact us for help.

5. Acceptable Use

You agree not to:

use the Service unlawfully or to violate another person's rights;
attempt unauthorized access to the Service, accounts, or systems;
disrupt, overload, reverse engineer, or interfere with the Service, except where applicable law permits;
upload malware or other harmful code;
impersonate another person or misrepresent your affiliation; or
use automated access in a way that harms the Service or its users.

6. Our Intellectual Property

The Service's software, branding, and materials, excluding user-submitted content and third-party materials, are owned by or licensed to the operator. These Terms do not transfer ownership to you. You may use the Service for its intended personal purposes, subject to these Terms and applicable law.

7. Third-Party Services

The Service relies on external services, including an identity provider and weather data from Open-Meteo. Their services may have separate terms and privacy notices. The identity service publishes its own Terms and Conditions and Privacy Policy. We are not responsible for third-party services that we do not operate.

8. Availability and Liability

We aim to provide a useful and reliable Service but do not guarantee uninterrupted availability, error-free operation, or the accuracy or completeness of user-submitted or third-party information. To the extent permitted by law, the Service is provided without warranties not expressly stated in these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including mandatory consumer rights. To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of information in the Service.

9. Suspension and Termination

You may stop using the Service at any time. We may suspend or end access if you materially breach these Terms, if required by law, or if needed to protect users or the Service. Where practical and lawful, we will provide notice and an opportunity to address the issue.

10. Changes to These Terms

We may update these Terms as the Service or legal requirements change. We will update the date above and provide notice of material changes where required. Continued use after a change takes effect means you accept the updated Terms, to the extent permitted by law.

11. Governing Law

Romanian law applies to these Terms, subject to any mandatory consumer protections and rights that apply in your country of residence.
